“NEC3/4 delay analysis conundrum – Retrospective vs Prospective analysis under the NEC3”
Speaker’s Profile
Hi I’m Kobus! I help construction contractors and built-environment professionals with construction scheduling, commercial claims and forensic delay analysis.
I am a PMI-accredited Scheduling Professional who has served as an Expert Witness in a number of Arbitration and Adjudication proceedings as both a Forensic Delay Analysis Expert and a JBCC Contract Expert.
Over the last 5 years, as a claims consultant, I have generated over R100M in compensation for customers through dispute resolution and settlements.
I founded Le Roux Consulting, a boutique construction consulting firm that assists contractors with outsourced scheduling, which I regard as a claims prevention service. Working with us has resulted in dramatic improvements in project success, financial gain, and stress reduction for our customers, who include construction contractors, developers, and professional services firms.
A little more about my adventure:
My first two employers were construction contractors, and both went bankrupt! The first was a medium-sized contractor, and the second was a listed group. I must admit that none of this was my fault, despite the fact that my friends keep reminding me that I was the only common denominator between these entities.
During this time, I worked “in the trenches” on a number of projects for the listed company, first as a Site Agent, then as a Contract Manager, and finally as a Business Unit Manager. As a result, I have a thorough understanding of the issues that Contractors face on a daily basis. I also developed a keen interest in construction planning / scheduling and the claims aspect of construction contracts, and how neglecting them on site quickly caused a cascade of problems that led to the demise of both companies.
Although I lost about four months’ salary between these entities, I am grateful for the lessons I’ve learned and how they’ve helped me grow.
This experience gave birth to a wonderful opportunity. Three of the listed group’s executive directors were my first customers. They were eager to hire me as a consultant and because they were high-level decision makers at their new companies, this provided me with a platform to demonstrate the value I could bring, and the rest is history. I owe so much of my professional success to these early adopters of my service and their encouragement to this day.
Today, I have so many wonderful customers from all over the world. Each has its own unique challenges, and I’m so glad that my team and I are able to add value to their business and be a part of their journey.
